Everything you should know about employee absconding

 


Employees are the backbone of the company. Do you know what happens if any one of the employees behaves irresponsibly, the backbone got disturbed?

Behaving irresponsibly refers to leaving the company without any traces or without informing anyone. There is a term for it named  Employee Absconding.


Now, what is Employee Absconding?

An employee is absconded when he or she leaves the company without informing their respective managers or their HR and also if anyone tries to contact them,

they don't receive the call.


Various reasons for employee absconding are:-

1. Due to health issues.

2. Lack of good relationships with managers and colleagues.

3. Work pressure.

4. Better job prospects

5. Fake commitment made during recruitment and 

because of many other reasons.


Now the question is what to do if an employee performs Employee absconding?

In case an employee gets absconded, a company can first send legal notice to him/her and if an employee doesn't respond to it, a company

can file a civil suit against that employee.


To avoid various kinds of such injustices against the company and to give fair treatment to every employee, various laws such as Employment laws, Labour laws 

have been introduced.

What exactly is Employment Law?

Employment law ensures the safety and promotes the health of every individual and states that there should be no discrimination toward any employee. It also states that 

there should be the establishment of a minimum required level for economic support.

Now you might be thinking what are Labour laws?

The Indian constitution consists of 44 labor laws for the betterment of society. A few of them are:-

1. Minimum Wages Act:- which states that wages assigned to various workers differ from state to state and according to their designation.

2. Equal Remuneration Act:- there should be no discrimination based on gender if they hold the same qualification for the same position.

3. Employee state insurance at:- states that various kinds of insurances such as medical for the family as well as individual and accidental insurance for individual.

4. Labour welfare Fund:- is provided to laborers for improving their working conditions.

5. Shop and Establishment Act:- is designated to regulate working hours, holidays, and terms of service.


Now, are there any kind of labor lawyers if any employer or any industry disobey these labor laws?

Labor lawyers are those lawyers which practice employment law in more brief. They can represent any of either the employee or employer's side.

With the help of labor lawyers and labor laws, you can file a lawsuit against your employer and even they could be fired.


All the previous laws (labor laws, employment law ) was previously mentioned for India but do they work for other countries also?

internationally many countries have labor as well as employment laws such as Austria, Belgium, Dubai, etc.

Now let's consider the employment law of UAE, Dubai specifically.

The employment law of UAE was introduced to ensure a healthy relationship between employers and employees. It contains resolutions for the employment of women and juveniles.

It specifies working hours and places and ensures safety and health.

The employment law of the UAE promotes the welfare of society and well being of workers.


Now briefing the UAE law:-

The law system in UAE (United Arab Emirates) is officially known as Sharia. It guides you to maintain moral etiquette and behavior. 

It is applied indiscriminately to everyone. It focuses on moral values more such as swearing in public places is completely prohibited according to UAE law.

Although UAE laws are a bit strict they consider their justice system fair and also accused is innocent until proven guilty in the UAE law system.
